Amazon Just Made It Nearly Impossible to Sue — And Started Hiding Reviews Too

Amazon quietly rewrote its Conditions of Use this weekend, reinstating mandatory arbitration and banning class-action lawsuits for U.S. customers — a reversal of the more litigant-friendly terms it had run since 2021.

Meanwhile, TikTok Shop just out-earned Target, Costco, and Home Depot online, pulling in roughly 2% of all US ecommerce spend in July — proof the platform is no longer a side bet for sellers looking beyond Amazon.

Amazon just rewrote its Conditions of Use — and this time it's not sellers feeling the squeeze, it's shoppers.

As of Friday, August 14, Amazon reinstated mandatory binding arbitration for U.S. customers and banned class-action lawsuits, with no advance notice — continuing to use any Amazon service now counts as accepting the new terms. Disputes get resolved privately, one customer at a time, instead of in open court.

⚖️ Why now

Amazon dropped arbitration clauses back in 2021 after roughly 75,000 customers filed individual Alexa-recording claims, burying the company in filing fees. The new terms close that loophole: any batch of 25+ similar claims within six months now gets treated as "mass arbitration" and resolved in batches, not as tens of thousands of separate billable events.

The same week, Amazon also started capping how many reviews some shoppers can read, flagging visitors it suspects are bots or AI scrapers and cutting off their access to the review section.

What this means for sellers

Neither change touches your seller agreement directly, but both are worth watching. The arbitration shift signals Amazon is getting more aggressive about controlling how disputes — including ones sellers get pulled into, like counterfeit or product-safety claims — play out. And if review visibility is being gated by traffic type, keep an eye on how that affects conversion on listings that lean heavily on social proof: a shopper who can't scroll past page one of reviews may be making a faster, thinner-informed purchase decision.

TikTok Shop Just Out-Sold Target Online — Sellers, Take Note

Forget "TikTok Shop is still niche." New transaction data says otherwise.

Analysis of US credit and debit card spending by Consumer Edge found TikTok Shop pulled in roughly 2% of all US online retail spending in July — up from 1.2% a year earlier — enough to out-earn Target, Costco, and Home Depot online.

🛍️ The numbers behind the shift

TikTok Shop cleared over $500 million in US sales during Black Friday–Cyber Monday week alone last year, and a small core of power shoppers — about 5% of buyers making 20+ purchases a quarter — now drives roughly 30% of total platform spend. Shoppers 35 and older were the fastest-growing age group by year-over-year spend in Q2, a sign the platform's audience is no longer just Gen Z.

Since launching in 2023, TikTok Shop has also rolled out a Prime-style membership with free shipping, and brands like Samsung, Disney, and Ralph Lauren have joined — a sign of growing institutional confidence in the channel.

What this means for sellers

If TikTok Shop is still sitting in your "maybe next year" pile, this is the data point that moves it up the list. With BFCM inside of four months, test a small slice of your catalog — your top 5-10 SKUs with strong video-friendly appeal — rather than waiting on a full-catalog decision. Sellers who show up on TikTok Shop before Q4 get first crack at an audience that's growing faster than the marketplaces you already know.
